Sorry but you’re wrong . It’s the CPS decisions to prosecute if they believe it’s in the public interest to do so. The police just present a case file to them, the CPS then decide to run with it or not.

The level of assault was also high. Only attempted murder and murder are higher. It was always going to go to court regardless if the victim made a complaint or not.
That’s not exactly true. She was charged with a Sec.39 (common assault with battery) and not a 47 or 18. Still, the point was that it’s a serious assault.

It was allegedly premeditated, with a weapon and he was unable to defend himself due to being asleep, so they were always going to press charges.
This is the "serious assault" on her Boyfriend, a small cut on his head.

I know more about this case now and have changed my mind completely, I think it's a disgrace they pursued a prosecution against her...

Hence why it's only a Sec. 39 and not a Sec 18 etc, However, if the evidence suggested he was asleep and she hit him with a lamp, that's pretty serious.

If I went at someone with a knife but only nicked them, the fact I didn't actually cause multiple wounds wouldn't negate the actual initial offence. Lo entiendes?
 
Just heard about Andy Weatherall, absolutely gutted. Genuine trailblazer, mover and shaker, never sold out. Met him a couple of times over the years, and he was one of the good souls. Still knockin out great stuff recently. Absolute one of a kind, very sad loss.


The best version of it by a million miles is infact the David Holmes remix which is epic and full of class and the one that was played in the clubs...listen.

 

Be embarrassed if I was him and that’s all that happened. Had bigger cuts bashing my head off cupboards.
He didn't want to prosecute, the scene had claret everywhere, her clarett after self harming, he phone the fuzz because he was scared she was going to do herself some serious damage.

Mate I've got that on 12" and the Septic Cuts LP, I know it well, its just that its very much Holmes' tune rather than Weatherall's.

While on the subject of who's tune is who's.....

If it was a man who had hit a woman with a lamp whilst she was asleep then noone would be sympathising with him.

Double standards.

If it had been a man or women, lashing out and hitting a partner with a lamp while in a state of mental breakdown, self harming, cutting her own arms, then you'd hope common sense and decency would prevail from the Police and she'd been referred to see a counsellor and given some help.

In these circumstances, it was in no way in the public's interest for her to be charged, which is what the CPS thought in the beginning, but had to change their stance when senior coppers decided to use serious domestic abuse laws to get her charged.

Do you want to see someone charged in those circumstances?, I certainly don't I can tell you that, I want an empathetic decision made which was clearly lacking here.

So the precedent should be that if a person is having some form of mental breakdown (details yet to be confirmed) then it should be counselling rather than charges?

Cool, the next time Bob batters his wife with a golf club around the head (only once) because he's apparently having mental issues then it should be excused.

What about if Tina decides to stab her husband during similar circumstances? What if Flack had fractured his skull? Does it need repeated blows to be criminal?

Oh, this is actually possible during the judicial system because a bench or judge can find someone not-guilty because of diminished responsibility. That not fair?

If the evidence suggests a crime has taken place, I want the police and CPS to investigate it every time and if needs be mitigation can be heard in court...

...not before hand. Like I've said, I have sympahty for the woman - I truly do -, but the needs of the many must go before the case of one individual.

Are there any examples of this?

Because when I see a famous man accused of assault or rape I see a load of people saying innocent until guilty and accusing the women involved of lying.

I didn't see any of this with Caroline Flack. Minds were made up before she got to court.
