My guess would be section 5 - Harassment, alarm or distress.

An offence of this kind is one where the perpetrator uses “threatening or abusive words or behaviour, or disorderly behaviour… within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby”.

Seeing as it was put on Social Media it has very much been in sight of persons likely to be distressed by it. Even if it hadn't been, presumably he didn't teleport into Wembley.

I suspect it may be 'Outraging Public Decency'. Criteria is the 'two-person rule' and intentionally acting in a way which is either lewd, obscene or disgusting.

They'll argue that he knew what he was doing and the insinuation that the message is obscene and disgusting. He may refer to the 97 points...

... but the bench will throw that out - well, it'll be the District Judge who'll likely do it - and rightly so.
