It's obvious that Moyes' hands are tied regarding VDM due to his contract. I'm fairly confident that Moyes probably would have off loaded him awhile back but hasn't done so. It can be the only explanation.

Other than Moyes thinking that he'll somehow still come good.

The really weird thing about VDM is that you hear NOTHING about him. The club says nothing about him good or bad. You really don't hear much in the way of rumors about him. He doesn't seem to be a troublemaker in the dressing room as we'd have heard about that by now.
