6 + 2 Point Deductions

Honestly, this discussion has suffered so badly from people getting things fundamentally wrong. I don't like it. I made a silly joke, you didn't understand it - don't worry about it.

Don't work out how Burnley have any case to sue us, after all it's the premier league that decided on the when where and how we were sanctioned. It's not like we said we'd like our sanction a year later, so if they want to sue anybody it's the premier league as i don't see what case we have to answer.
 
I believe it's for 21/22. We finished 4 points above them, they went down. In October 23, we were docked 10 points for our 21/22 breach, it was eventually reduced to 6. So I guess the argument is that had we been docked 6 points in 21/22, we'd have went down.

Think it's still a load of crap, myself.
Imagine ploughing ahead with a case against a club that has already served it's punishment but using the argument "the punishment they got didn't benefit us"
 

Did Forest get sanctioned for the same period that Burnley are seeking to claim from? If so, does anyone know why Burnley are having a go at Forest?
Its the 21/22 season they're claiming for when Forest were still in the Championship then. Its the season they got relegated and we finished 4 points above them that they're crying about. We then got a 6 point deduction the following season (after appeal) meaning if the deduction had happened the season after Burnley had already been relegated. Burnley would have stayed up if the penalty was the same season.

The number of variable factors that cant be quantified and the fact it was the premier League (not EFC) that decided on both the points deductions and when they were applied means that they don't really have much of a case. I sincerely hope they miss automatic promotion and get knocked out in the playoffs, the bunch of 6 fingered scruffs!

You simply can't calculate things like that. If we'd had a six point deduction we might have turned a draw into a win as we'd have needed that to stay up.
 
I don't blame Burnley for giving this a go. If the situation was reversed I think most people on here would be compelling Everton to take every legal avenue available to get some redress. I don't think they've got a snowball's chance, but I totally understand them giving it a whirl. Burnley aren't the enemy here, the PL is with their "making it up as they go along" approach to this stuff.

Then their case has to be with the league and not us. They were not transparent with their laws and only decided to enforce them when teams complained instead of nipping it at the start. Their negligence started this whole mess

Also the leagues choices to defer punishment to the following season. So their issue is with the league and the punishment rather than with us. We didn’t punish ourselves and didn’t choose when we got punished or by how much we got punished by.
 
why do burnley even have a case. They benefited from the points deduction, they just didnt take advantage. We got 2 separate points deductions last season whilst burnley were a premier league team. The first points deduction should have been applied the season before but Burnley werent in the premier league that season as they had been relegated the season before. It should be Leicester, Leeds and Southampton who got relegated that year that should have a case over the fact that we didnt get the first points deduction applied the season it was meant to be applied

This is what i cant grasp. we got the 10pt punishment in 23-24 season that should have really been applied in the 22-23 season. It was never going to be applied in the 21-22 season as the accounting period for that year doesnt end until the end of June 2022, a month after the end of that season and the accounts for that year were not due to provided until January 2023. Its a practical impossibility that it could have been applied in the 21-22 season
