If we win the 1st appeal, does that mean the 2nd charge will be void ?
Depends on whether we win the appeal in full , that is the appeal commission accept that our method of accounting was correct and the PL.were wrong ( unlikely ) in which case yes the 2nd charge might be rendered null.

However if the appeal panel simply say the 1st punishment was too harsh that has no effect on the 2nd charge
 

About time the club adopt City's approach now.

It's bizarre that a team building a stadium can be punished under sustainability rules. That's not a reason you should be punished under P&S rules surely?
We were trying to benefit from building the stadium by lying about what the loans were used for. We tried to offset the interest payments for the working capital loans by pretending they were being used to fund the Stadium.

The terms of the loans were then published on the companies house website in the charge documents. It was probably the dumbest attempt at fiddling the P&S rules possible.
 
I know it's been said already but I just don't see how they can punish us twice. We have already received a sanction for 2019 to 2022 so to use it for 22/23 has to be an abuse of process? You don't get two bites of the cherry in criminal law, why is it allowed in civil law?
 

There'll be clear arguments against it.

But because they want to "fast track" it...I can see them slapping 5 more points on by April Then hope the appeal clears some points before the end of the season.... before appealing the new breach.

Or they could be understanding and delay/fine.

Bottom line is they don't have any rules in place for it.

I think that argument will be sustained by any independent panel. How could it not?

We won't though get any points back from the 10 already deducted.

The big issue now is the mentality of the players and how that holds up.

If they are going to pay any attention to legal principles then given there is a 75% overlap to prevent double counting the punishment for the second breach should only be 25% of the first, so if it sticks at ten it should be 2-3 more max.
 
It took 8 months for the 'Independent Commission' to to a decision.

There's the appeal in now which will take 'n' time and these charges should surely not be looked at until the appeal process is over.

If the appeal is successful and say they completely remove the points deduction that means this charge is completely redundant because it's based on the original charge.
