I think you could give the penalty or not. What I find difficult to understand is why you would make comments which run the risk of putting the backs up of an important element of the game before you have any reason to. We've seen enough debatable behaviour from referees to know that they are not the impartial decision-makers that Webb and the PL would like to paint them as.
