What do the club say?​

Everton did not hide their dismay with the Premier League and their belief that the organisation is making up regulatory practices as it goes along. A strong statement said: “The Premier League does not have guidelines which prevent a club being sanctioned for alleged breaches in financial periods which have already been subject to punishment, unlike other governing bodies, including the EFL. As a result, and because of the Premier League’s new commitment to deal with such matters ‘in-season’, the club is in a position where it has had no option but to submit a PSR calculation which remains subject to change, pending the outcome of the appeal. The club must now defend another Premier League complaint which includes the very same financial periods for which it has already been sanctioned, before that appeal has even been heard. The club takes the view that this results from a clear deficiency in the Premier League’s rules.” Everton also believe the £105m threshold is outdated and has not taken into account the inflation of wages and transfer fees over the past 10 years. The Premier League is changing the PSR rules in August.

What could the punishment be if found guilty?​

A fine, a transfer embargo or another points deduction. As Everton’s statement mentions, there is no rule to prevent double jeopardy in the Premier League. Therefore, the club could be docked points for a second time this season despite November’s 10-point punishment covering 75% of the period that the latest charge relates to. Everton have spoken with the Premier League about the risk of double jeopardy and bringing in measures to prevent it, as the EFL has done, but have been informed the final decision will rest with the commission that hears their latest case.


In regards to EFL rules and double jeopardy.
 

They accepted 2 of our 9 grounds of mitigation. Does anyone know if the Richarlison one was accepted? Hopefully not, as if it's been rejected it leaves Forest with no defence at all.
They only found in our favour for two things. First that the original IC should have followed EFL precedent. Second that the conclusion that EFC had been less than honest was incorrect. All other matters dismissed
 

I'm not sure it works like that. We have a team full of players that can do a job and grind out results in the premier league. But that doesn't necessarily transfer over to a good points total in the Championship where we would need to play like a top 4 team dominating possession home and away and looking to win every game. When I look at teams like Norwich and Ipswich play in the Championship they play really good attacking football. I don't think we can play like that with our current players. Where would the goals come from to achieve an 80 plus points total? We would need to bin all of the players that are useless in possession like Mylo, Godfrey, Gana, Harrison, Beto and get a more reliable finisher than DCL. There are loads of strikers that are better championship level strikers than Beto and DCL but would be less effective than them in the Premier League.

209. First, the benchmarks relied upon by the Club, notably the EFL P&S Rules and EFL Guidelines. The EFL Guidelines reflect the extent of the breach in money terms. They have a starting point of 12 points, but that is “top down”: excluding aggravating factors, it is the maximum deduction. The points deducted are reduced from 12 if the breach of the EFL upper loss threshold is less than £15m. For a breach of the EFL upper loss threshold of no more than £2m, and leaving aside “trend” (dealt with below), the points deduction is three points.210. Absent any particular mitigation, three is therefore the minimum points deduction prescribed by the EFL Guidelines, with an increase in that minimum to reflect extent of breach in money terms of one point per £2m-£2.5m up to a maximum of 12 points leaving aside any particular aggravation
