I don't blame Burnley for giving this a go. If the situation was reversed I think most people on here would be compelling Everton to take every legal avenue available to get some redress. I don't think they've got a snowball's chance, but I totally understand them giving it a whirl. Burnley aren't the enemy here, the PL is with their "making it up as they go along" approach to this stuff.

Then their case has to be with the league and not us. They were not transparent with their laws and only decided to enforce them when teams complained instead of nipping it at the start. Their negligence started this whole mess

Totally agree but the system is set up with the following hierarchy:

1. The PL
2. The Scab six
3. Everybody else

So, if someone is to blame, according to the PL at least, it will always be someone from group 3 and certainly not group 1.

Agreed, but the system all the PL clubs, including us inexplicably, signed up to essentially protects the PL above all else. So Burnley have to go after us because the PL have essentially set up a cartel that makes the rules, administers the rules and acts as judge, jury and executioner and are untouchable without going outside the system like Man City have. Most clubs don't have pockets that deep.

What were we supposed to do, administer the punishment to ourselves in the correct season?

The weird thing is Burnley actually got the benifit of the punishment, they were in the PL when we were docked points.

Burnley like they’re not one of the favourites to go down every season anyway. If they want to stay in the league maybe they should stop playing football like it’s 1897.

Again, I agree, I don't know what to tell you. The system is a closed shop and it's rigged. That's not Burnley's fault, it's the PL's fault but, as I've explained, Burnley cannot seek redress against the PL so that leaves us. I strongly suspect they have little chance against us either but it's their only shot.

We should just ban anybody remotely associated with Burnley from the new ground, meaning any time they play us they'll need to forfeit the fixture and we'll get the three points.

My concern is that there is a willingness to settle, if the hearing will be before an arbitration body.

Perhaps as in a civil case they would do so without admission of liability.

They must have some idea of how much they might be on the hook for and TFG would have been aware of this as part of their due diligence.

How can the club finally put an end to this afterwards though? As the other clubs dropped their claim what is to stop them or any others returning with new claims if the judgement is against us?

Its only the PL liable as the contract was between them and Burnley and not us. Stupid ...

If this case goes anywhere near awarding Burnley a penny, then its going to open up a bigger can of worms than anyone could ever imagine further down the line. The city case for example, will turn into an endless mess of court cases for the rest of time, with the PL fully in the middle of it! This needs throwing out before it even starts.

I believe it's for 21/22. We finished 4 points above them, they went down. In October 23, we were docked 10 points for our 21/22 breach, it was eventually reduced to 6. So I guess the argument is that had we been docked 6 points in 21/22, we'd have went down.

Think it's still a load of crap, myself.

But it’s impossible to deduct points for a breach of that season within that same season. Unless you submit your accounts the minute the final whistle goes on the last day of the season and it’s all audited and resolved within like 2 weeks. (Which would just look like a farce anyway after the season has concluded).

So a punishment will always come the season after at the earliest.

They signed up to those rules just like we did. We got our punishment, and we actually got it when they were back in the PL. It’s on them for being absolute garbage that even after a team has 8 points deducted that they still finished 16 points behind them.
