Without knowing the year by year financial details, it would be interesting to see if there has been a significant improvement in the new year brought in for the period being assessed for the second charge. It would certainly help any appeal if so.
I'd be incredibly surprised if 22/23 was an improvement on 21/22, the figures don't really add up. The Premier League referred to this in the original case as well.

Everyone seems cock sure that a second charge will receive a lighter punishment because it will include two thirds of a period that has already been subject to sanction. I wouldn’t be so sure. I don’t think it’s supposed to work like that.

They are supposed to be assessing the accumulation of two separate accounting periods, where the same rules apply for each accumulative three year period.

The fact that we breached a second time, when we’ve supposedly been given the opportunity to get our house in order for the second period, could actually be seen as an aggravating factor if anything
 

We definitely get the 2nd charge punished this season.

This was agreed by all clubs pre-season so as to only impact the teams you're competing with in season rather than 3 new ones next.

The dagtbthing is, once this was agreed the PL should have said "OK, we'll view a four year period as a one off and only have you in front of the commission once."

To have us up twice in one season means we end up with five points tallies.

Points we've won.
Points after first hearing.
Points after appeal.
Points after second hearing.
Points after second appeal. (final)

It's an absolute farce, but no.... You can't punish the fans. It's unfair.
I Agree they are changing the format before Next season starts so if the second charge has not been sorted
By the end of this season there is a chance it will be scrapped ???
