6 + 2 Point Deductions

Nobody is telling porkies, as such, I found it in the report, but its very strange, they reject The Premier Leagues sanction and then impose the exact same sanction.
So they didn't reject the the Premier League's sanction. They just say they did and lots of words are used to hide the fact.

Can't adopt the Premier League's sanction policy if they are independent, can they?

The denial from you is breathtaking. Moshiri has come out and admitted that we had to carry on spending because the midfield was crap. As for Forest the reaction from their fans is totally different. They have in essence put their hands up and know the club broke the rules.
If you think moshiri has any clue about buying players with a plan😂. What you think got us in this mess, also think forest like us have no accepted they have broke the rules because not been in the prem for the 3 yrs.

It seems that way mate. We'll get more points deducted for this and then a good chance 9 more when we inevitably go into administration. The writing is on the wall.

The guidelines advocated by the Premier League are similar to, but differentfrom, those of the EFL. As with the EFL guidelines they start with apresumption that the appropriate penalty will be a sporting sanction in theform of a deduction of points. They adopt a fixed starting point of a deductionof 6 points. There would be an increase from that starting point of one pointfor every £5 million by which the club had exceeded the PSR threshold of£105 million. Further adjustments could be made to reflect aggravating ormitigating features. The rationale for this view is given in the evidence of MrMasters.88. The Commission recognises the attraction of a regulator imposing astructured formula that was required to be applied in breaches of a particularregulation. Such a structured formula would fully inform clubs of theconsequences of PSR breaches – although that would deny the Commissionthe power, as a specialist tribunal, to approach the question of sanction inwhatever way it considered to be appropriate to the individual case before it.89. Nevertheless, the Commission is concerned that the adoption by it of a28structured formula such as is advocated by the Premier League would beinconsistent with the unrestricted powers conferred by Rules W50&51. Weconsider that it is not for a Commission to introduce such a structured formulaeven on a case by case basis. We consider that we are required by the Rulesto hear and consider the mitigation, after which we have a wide discretion toimpose any of the sanctions listed in Rule W51. If the Premier League wishesto impose a mandatory structured formula on a Commission dealing withPSR breaches, it can do so. In that event the Commission would be requiredto comply with those Rules. But as things stand at present that has not beendone: the Commission has the wide discretion conferred by Rules W50&51.90. We therefore decline to adopt the structured formula proposed by the PremierLeague. We will determine the appropriate sanction according to all thecircumstances of the case, including (as required by Rules W50&51) anymitigating factors.

Important bits.
I think they stipulated they haven’t adopted the formula because they knew it was done on the back of a fag packet and without any approval from the clubs would be open to challenge.

But they gave the exact award which is certainly fishy to say the least. “This is the sanction but this isn’t the reason, honest”.

In a way it feels like they’ve tried to cover themselves by not given any reason for their decision but stating what the reason isn’t, it certainly makes it harder to appeal the decision when you don’t know what WAS the reason.

But the failure to provide reasoning, coupled with an argument about them de facto adopting the sanctions formula will be a big part of the appeal I imagine.
 

so that’s it the club is over?
We will never be over as I stated any good barrister for us going to the appeal over the first judgment i.e. 10 points deduction should first ask the so-called independent panel what our their credentials, & who they support in football for the record before he or she starts the appeal ...
In a court of law, jurors can be kicked off the jury - if they are familiar against the client or if it is loaded against the defendant....

Same should apply here .....
