The law is clear...Definitely a foul. However, concept of fairness which is the overarching goal of the laws of the game would indicate that giving a penalty when he is nowhere near the ball would be unduly harsh. For better or worse, the rules in football are largely left to the discretion of the match officials to ensure a fair competition. That there are doubt about that is not down to the rules, but the honestly of the referees.Same way a pull of the shirt when the ball is in the air is a foul!

I agree and that is the reason why we absolutely have to have the refs mic'd up in the stadium so that we can hear their thought processes and justifications in real time.
