If the Collyers are on here and still are involved with Sports Interactive, I hope they win this most ludicrous of court cases:


Unbelievable, from the greedy bleeders!

Surely they haven't got a snowballs chance of winning?!

Makes me think that they are really in the shoite financially, as it reeks of desperation.

All this does is stop the people all round the world playing as Manchester United in football manager which in turn will effect younger people from adopting them as one of their teams.

I really do think this is a bad PR move and will set a nasty precedent if Utd won . They are even having a pop about the ease of which you can mod the game to add logos , player pictures , kits etc .
I'm very interested to know why you think this will fail . Don't get me wrong , I really don't want this to win but surely they have a case even if it it is a small one.
The game uses the name of the club , names of the facilities and it's staff .

It does, but its going to be almost impossible for them to prove this is a breach of copyright. After all they have suffered no loss, SI aren't marketing this as anything other than a generic football management game (ie its not Manchester United Manager) , they've been doing it for at least twenty five years without complaint and one half of their case (SI not using the club crest) directly contradicts the other half (SI using the name).

Lots of published work does the same. Images can be copyrighted but not names and there's no intent of "passing off" as far as I can see.

United's case seems to be that the game doesn't use their copyrighted images, the consumer buys the game expecting to see that image in association with Man Utd while playing, so the publishers should have to license that image.

It's a big reach.

Yep and the other lot are Merseyside Red and lots of other team changes as the makers of PES do not have the rights to use them. Not sure how that has worked fom CM/FM over the years as they have always had the proper team names from the very start and the player and staff names came a few years later.
The other strange thing is that FM has no rights to use the German national team players for their national team but can for Bundesliga clubs so random made up players get picked for Germany in the game and you can download a patch to fix it up. Which is the first thing I do when I get the game.

It's not been unknown in the past for sports games to have to change the names of clubs and/or athletes ever so slightly so you still know who they are but it's not their actual name. I presume they did that for some legal reason, so I wouldn't be surprised if there is something in it. This place was threatened with legal action, I believe, for using the fixture list, and were also threatened with such for people having the club crest as their avatar. Morals and football don't really go together any more, if they ever did.
