No question it's in bad taste but it's definitely not ensighting racial hatred or whatever he has been done for. Jokes sometimes ride on the fine line of something you find appalling or abhorrent to invoke a reaction and a sense of schoolboy naughtiness, some will hate, some will love. Doesn't mean you like/agree with the historical event in question.
 
It’s so bizarre. I don’t find the joke particularly funny but I don’t see why or how you can charge someone with a crime for making a joke.

The scary thing is that he told the court the context of the video, that it was a joke, and they then decided the context. If that’s the case for this kind of law they could charge anyone with this for any humour or speech they disagree or disapprove of. It’s a scary precedent.
 
A custodial sentence seems slightly harsh considering the things people get away with these days.

Two young thugs burgled my niece's flat and trashed it. It had just been newly decorated. They also damaged photos of great sentimental value and stole all sorts of jewellery. They didn't even get a suspended.
