I just used to know a few people who worked for the CPS in various capacities. As an organization they are extremely risk-averse. If they thought there wasn't a reasonable chance of conviction at murder, they'd go down the list until they found a charge they could prove.

So to be found guilty of murder you need a motive and you need to plan it out yeah? Don't really see how thay can make a murder charge stick in this case.
Plod attends scene, Atkinson going a bit weeeeyy, taser out, bang and he snuffs it. Hardly intent.
With my tinfoil hat on maybe the CPS reckon that the murder charge will never stick in front of a jury and so plod gets off. If the charge was manslaughter then maybe it would stick. I also don't think you can be charged for the same crime twice in this country ...not sure? If that is the case then this whole episode goes away and leaves civil litigation by the family as their only option for justice?
