6 + 2 Point Deductions

Why is the decision for these points taking so long? It affects everything, our mentality after the red card today could have been so different if every point didn’t mean so much. I know it was bad management but you even look at how other teams are playing around us and right now they see a chance to finish above us. Ridiculous that such a large item is taking so long
Especially when the decision has probably already been made.

I dont think it works like that. Until the appeal is final then nothing is confirmed so I dont think it's as simple as saying everyone should just assume worst case scenario.

It's not just this -10 deduction either. It's not just this appeal verdict that we're waiting on. It's also the fact that the appeal could have a big impact on how the second charge effects us. And also the team directly above us (Forest) could also lose points at some stage. But we don't know for sure and no one has a clue how many points it could be.

There are far too many unknowns for this stage of the season. And they all have an impact on what happens on the pitch. All the uncertainty is a massive issue for sporting integrity.
I'm not arguing that this process isn't absolutely absurd here. But in Dyche's argument there are only two points in time where the deduction can happen: back in November, or when the appeal has been decided. It makes no difference whether it's explicit on the table or implicit. If they don't assume worst case scenario (barring anything ridiculous like increased deductions), slack off and get fewer points than Luton, they'll be screwed if that scenario happens. Honestly, it's Everton, we should be expecting it.

And that is the reason why we should sue the ass off them no matter what the outcome is. They effectively destroyed the majority of the season for the club, players and supporters as it has had a negative effect on everyone. They should not be allowed to get away with it.
If you commit a crime and plead guilty, you appeal while in Prison.
We can’t expect to keep 10 points while appealing.
Dyche is using it as excuse now, manage the team how things are any points back is a bonus.

With the way we are going, we are not going to know what we need to stay up, till maybe very late into the season due to the 2nd charge and the wait for that verdict, and by that time we may be on the last games, or the season may even be over, so we may have no chance to gain points if we actually needed them. The whole thing from start to when ever it ends has been farcical to say the least
Agree, totally ridiculous. That the league would actually put into effect a time table that provides for a potential for the resolution of the second charge (or first change for Forest) to extend beyond the end of the season (if it is appealed) is simply not acceptable. To not know who stays up and who is relegated on the last day of the season is a farce. They must accelerate the schedule for these charges, it's not fair to any of the teams toward the bottom of the table, nor the fans and players for that matter.

We don’t even know what the second breach is so it is made up?
That’s correct .

That said there was a line( I am at it again ) in the written reasons that if I have read it correctly suggests that the trend of the extent of the bottom line losses in 2023 wasnt downward.

Or put another way the loss in the yet to be published ye 2023 accounts will be greater than the £44.7 statutory loss in 22

Self report that we were working with the Premier League.

They knew our financial situation as they were working with us.
It really depends what you mean when you say “ working with us”

There is no doubt that the PL sanctioned each signing but they did so with a caution that it was Everton that were responsible managing and were accountable for matter’s financial.

We also know that at one point that Everton were reporting that they wouldn’t be in breach if the club were able to be given a concession in effect being able to discount expenditure stadium expenditure that was pre planning and couldn’t be capitalised according to accounting procedures.

Terrible analogy tbh. We were never even accused of committing a crime. Our offence was a rule breach, kin big deal. The process which they mostly made up as they went meant that appealing was part of the procedure. Therefore, until that appeal had been completed, a determination of guilt had not been satisfactory completed and hence any attempt to inflict a punishment beforehand could not only prove to be unjust and incorrect but also very damaging to the entire club for a substantial part of their season. Punishment if required should only ever be actioned upon completion of the entire procedure.

That is why legal action should be taken against them no matter what the outcome.

It is clear in the rules that there is an appeals process, they didn't make that part up as they went. The analogy makes sense.

No chance. @chippy1722 is completely right.
