I wouldn't put any money at all on Esk being right.

But he has stated it as a fact, and on something as important as this people will never trust him again if he has just made it up. For someone who has built a reputation for his blogging and his podcast and got numerous writing gigs off the back of it, it would be a strange and spectacular way to torch his reputation, I don't know why he'd risk it.

He might try to cling to semantics if we are charged but for me he'd be done as someone to trust.
 
How the hell are we over when we’ve had the 3rd lowest net spend in the last 5 years? Is solely stadium related and the total mess we made of securing the funding?
Could be a good thing if our super silk manages to get sanctions properly acknowledged as a mitigating factor. And with stadium costs not counted towards PSR at the time.

Were we supposed to just gaze into our crystal ball and stop building?

Im just saying, they denied it last time, im pretty sure they will this time.

But thats why we got SuperSilk in, to argue that point for us and others.

Sure, I wouldn't be surprised if they maintained that stance either. But my point is that it's a really ridiculous stance to be maintaining, and that it's really open to challenge. I think that their stance is weak and ignorant, and that our claim for mitigation is strong on this issue.


Also, I'm emphasising the point that the consequences of the Ukraine War only really become relevant for this latest accounting period. I don't think we actually lost any revenue due to the Ukraine War during the period relevant to our initial breach.
 

If both ourselves and Forest received a 10 points deduction, that would still only leave us 5 points off safety.

We can do this. We really can stage the greatest escape in football history, but it is absurd that it's come to this.

As an aside, don't we have a net spend of just a few million Pounds since 2019? These rules are not fit for purpose.
 
This makes me think... Ukraine happened about halfway through 2021/22. So if our super silk can successfully present this for the original appeal vs the 10 pts, could that not carry over to the charge we seem certain to face tomorrow?

After all if we're being punished for the same offence twice, surely the same mitigation can be used twice. Which makes going all the way with the second breach utterly pointless.

Nonetheless, I await Sky Sports' freshly prepared league table tomorrow morning, with a double asterisk next to our new tally of 7 points. We are repeat offenders after all.... bring it you corrupt fkers!

I think we received all the sponsorship money for 2021/22, which does make the Ukraine excuse a bit redundant for our initial breach. However, it makes it entirely relevant if we are charged with a second breach, as it caused a sudden and unexpected reduction in our projected revenues for the accounting period in question.

It's genuine mitigation, and it would be a disgrace if it is not treated as such. You would have to wonder what on earth would be considered valid mitigation, if this type of unexpected event is met with a "Deal with it" response?

It is and it isn't - yeah I think he's been wrong on a lot of details, and I don't like the way he states his opinions as facts. But he's been shouting from the rooftops for years that we were making huge financial mistakes and being massively mismanaged even when people didn't want to know, and now we're hammered by FFP and living off payday loans I think a lot of people who dismissed him as a pessimist would admit he was right more than wrong.

The jury's out for me, but he's stated two facts for certain (we're within the PSR limit & 777 won't take over Everton) on which he'll be judged, so we'll know soon enough if he's credible or not.
 
Let's not over react till we hear the outcome , we may well have overstepped the mark and maybe different than the original misdemeanour.
Penalties could be a fine , transfer ban even a suspended punishment. It could be no case to answer.

But let's be honest if the club have left themselves open to this heads should be rolling.

Regardless wether this whole process is right or wrong , the club should never be getting itself in this sort of predicament.

All the main culprits of our financial mismanagement (Moshiri, Kenwright, DBB, Inglis, Walsh, Brands, assorted managers) have all gone or in the case of Moshiri is pretty much gone. There’s no heads left to roll.

The likes of Chong, Thelwell and Dyche are cleaning up the mess that’s been left to them and don’t deserve any further mess thrown at them.

Fair comment and probably why the PL dismissed it so readily. However, the crucial point is that the stadium wasn't included in PSR back in 2021/22 but suddenly was early last year.... in 2022/23.
 
Fully expect an instant points deduction for both at 9am tomorrow. Banana republic.

It goes to the 'independent' commission to decide the penalty first....that just happens to be conveniently the one recommended by the PL.
