Obviously he's a bit of a knob, but the verdict/non-verdict makes sense.

If they start doing people for what they say in private it'll cause all sorts of trouble.

Not sure about that as a defence mate, what if someone was filmed agreeing to throw a match, they could just say, "oh it was private."
 

I should point out that racism is illegal

If two people were plotting to murder someone in private, or commit fraud in private, or rape someone in private, but then someone found out about it, should they be allowed to get away with it because it was private?

This was two people who broke the law and were caught out

I'm not sure exactly what it is Mackay has done so i say this based solely on what i've read in this thread.

But i've bolded the key part in your post. Plotting to murder someone is illegal. Wanting to murder someone isn't.

If all Mackay has done is make racist comments in private that have since been made public by someone else then it's not a crime is it?
 
This is a very complex issue. Maybe that is why the FA kicked it down the road for now. Racism is against the law, but is it racism if I am racist but do not carry out any acts of racism. Is it racism if one racist talks to another racist in racist terms. Where is the crime, the demonstrable harm. If I speak in public in racist terms then I can cause offence or convince a third party to cause offence. That is a crime. If I speak in private to a person or persons then I can cause them offence or be seen to be convincing them to be racist.
If they had been talking about discriminating against someone due to their race or sexual orientation then it is a crime.
I don't like the FA, I think they are spineless, self preserving non-entities, but I think they may have got this right, although they have done so by default.
The bigger question is who will employ him?

You are wrong. What they did actually wasn't against the law. Hence why no punishment from the FA..

I'm guessing you can be racist in private.
