Landlord not returning deposit

Hi All,
Any one ever had an issue with a landlord not returning your deposit.

I moved out 2 weeks ago....landlord said she was away the weekend I was moving out, but would settle up with me when she returned.
I've since texted her, and rang her, to no reply. Called round the house but she wasn't there.

Have lived there 4 years, and in that time no damage was done to the house....except for the Plastic shower handle hanger thing breaking (not by me, just normal wear and tare I reckon), and she's never commented on it (would imagine to replace the broken part would cost no more than 30-40 Euro anyways)....

I've paid all bills, and rent was always paid on time...

One problem I might have is, rent has always been paid in cash (with no receipts), and I never had a contract with her....we initially agreed 6 months by e-mail, and that rolled on to 4 years...

So it seems like she's chancing her arm here...


If it's happened to anyone else, what steps can I take?....I've emailed the Residential Tenancies Board tonight, so awaiting a reply there...but that seems a long route to go down...

Over where I am there is a Renters board organization that helps people out with these things. Try looking into that.

With no paper trail though you might be up a creek without a paddle.

Do you have emails confirming the amount you have been paying her? That sort of correspondence in writing would help you out a lot.
 

Your deposit should be in a legal system. Can't remember what it's called off the top of my head but unless there is genuine reason as to not return your deposit then legally the landlord cannot take it back. Makes no difference how you paid your rent, entirely different issue that.

So get in touch with the deposit scheme that it is held in and put a complaint in about it. Landlord cannot then touch your deposit without one party agreeing to releasing it to the other.

If there is no legal issue on your side of things you can fight him all the way for it

Think the issue is that he can't prove he paid her a deposit and so can't therefore pursue legal avenues to get it back.
