Morning all,

Just wondered if anyone on the forum is going through or has gone through this.

After 5yrs of being over here in Texas, my (UK based) ex-wife has decided to throw me into court for Child Support (in Texas) when they (ex-wife and son #1) live in the UK.

Since I've been here for 5yrs, I have continued to pay the same as I was paying in the UK when I left.

UK rates are 15% per child, US rates are 20% - and they take into consideration commissions which were never taken into account in the UK.

If anyone has any advice or guidance - I could do with some right now!!

No expert but wonder if you would be better getting formal advice from UK CMG.
 
Been through it over here mate, but wouldnt know where to start in your case. I guess your residency would be some sort of factor for a start.

No current agreement in place. Used to go thru CSA in UK.

Trouble is - over here they take into account commissions (never did in UK) and I'm paying her (and have done for the last 5yrs) what I was in the UK before I left. Salaries are comparable, fundamentally, if you take my last base in UK and x 1.7 then it equals current base...

get some legal advise , mate they have an agreement in place that any payments agreement given by a UK court can be enforced over there, but they cant take it direct from your pay unless you work in some jobs, ie british owned companies,
If you are on about the same pay contact the csa yourself , they are helpful and you can make an arrangement through them even if it slightly more, it makes it harder to go to court if you do that, and you get the added bonus that they go through your ex,s details with a fine tooth comb as well, any benifits she is getting,if she is on them.
Havnt been trough it abroad but did it here, they were very helpful and as mine was a private agreement ,it really didnt need to go to them, but she just had to try, they gave me all the details of how much i should have been paying, which was less than i had been , and said it would be logged for any future date that i had been in touch and advised that i was paying the correct amount, as long as i didnt miss any payments she couldnt do a thing.

Honestly, what a shitty situation. The only reason she's putting it in courts in US is she will get more. She could've put me in court in UK, but they'd have laughed at her. Been paying for last 5yrs with no court orders or CSA involvement - nothing.

But Texas comes down hard on the side of the mother, so me = not happy Mudguard!
 

As long as she spends the money on your son....

Anyway the pound is worth more than the dollar so would it work out much different? Or are you earning comparatively a lot more in the US?

It's not so much the exchange rate, CSA is calculated by 20% of net income in US v 15% of net income in the UK. US takes into consideration commissions, UK does not.

So she stands to get a LOT more due to my commissions.

give the CSA a ring , if you can prove you have been paying a regular payment, it might count as a private agreement, see if you can chat on line. there not bad mate honest, fella I last spoke to said she is a bit cheeky and greedy mate do you want me to run a check on her ,would have landed her right in it if I was that way inclined,

I'll give it a go...I spoke to a lady at the CSA on Saturday. She was lovely to deal with. Told me much the same as your fella.

I wonder when this ruling will change. The ruling where the courts are in favour of the mother 9.9 times out of 10. Where is the EQUAL in this ladies ? you kin money grabbing sluuuuuuuuuuuuuu ........ ayyeeeeee never mind. Wasting my breath.
