Does anyone have any advice on how to claim on 'small' injuries when injured to lack of health and safety?

Basically, this morning I was on the train - I went to go to the toilet and there was a metal panel hanging down from the ceiling of the train. It was very thin so pretty hard to see, and there was no sign mentioning it etc. and it was purposely opened due to maintenance. I whacked my head on it, cut it.. blood everywhere and ive had two stitches and a tetunos jab. I pretty much feel ok but the docs said no screen time for 2 days, so I won't be working. They filed in an incident form etc but didn't really say that would happen next. I got a pic of the injury and I guess there might be a loss of earnings thing plus health and safety.

Is the best way to go through the train company first, say no to the first offer, wait for the second and go to ombudsman if not happy?

Yeah got a pic of the cut with the stitches, and the form said the train people took some pics too also I swear I didn't see that
Did you get a pic of the metal panel/ceiling blade? And your bloodied head immediately after injury in all its glory? You have your train ticket and can find the right train? It might have been service/maintenance unfinished or hurried. The work log book might help you isolate how this occurred. Could it have been vandalism?

Nah I probably should have taken a pic of the panel, but it has been noted, or all the blood but my hands were covered in blood at the time. It definitely looked worse than it was, but obviously still required two stitches and a jab... Plus sitting on the train for 30 mins with blood on me and people staring!

The guy said he was open due to maintenance like that was meant to make it fine. They were all nice about it, looked after me well, but you can tell they knew they were in the wrong and were probably crapping themselves a bit. It if was an elderly person or something, who know what could have happened. I feel fine now considering, but I guess what happened was pretty bad. I m just not sure on how I really put a value on it

Despite that the company has a duty of care to its customers. It's like that warped way a burglar can sue a house they've broken into.
You'll need proof it happened at all.

As much of an ambulance chasing scenario it is, write to them see their response, they'll probably offer an hour's free travel and a slightly damaged chocolate orange. Take that to a brief on no win no fee. Get yourself a holiday and watch as everybody else's ticket prices go through the roof 😊

No, I didn't take a picture of the form which is a bit annoying now come to think of it, but I was thinking about other things at the time when on the train. I'll just email them and go to the ombudsman if I don't agree with the offer. I'm not really sure on the amount at all that I expect, other than the refund of my train tickets

Pffft! The younger generation!

Thank your lucky stars we have an nhs and free treatment, and from now on look where you're going. Accidents happen, minor ones all the time and humans are self healing, private company profits aren't. Do you want the owner / shareholders of the rail company to have to pull little Agnacia from her private school over this?
 
You would need to get a medico legal report from a gp. The standard charge for this is £216.00

I think you can make a claim through the official injury claim portal

If you instruct a solicitor most of them will take 25% of your damages and they will also take out an ate insurance policy in your name for legal expenses cover which is around £258.87. Better doing the claim yourself especially if it’s only a minor injury.

OIC is for road traffic accidents so don’t if that would apply to you or whether yours would be an el/pl claim
 
Not seriously injured, in all probability no ongoing issues arising from injury, didn't have to pay for health care.

Of course, I've never done anything like this before so why not give it a go. just because I've been fairly laid back about it doesn't mean it's less bad
