Important: Private e-mails

I've always maintained on here that publishing private e-mails on a public domain is in bad taste and have always actively removed them from view. Whether from an Everton employee, or another member - private emails being published on here just doesn't sit right.

And above all - I don't how where we stand legally. There must be a reason as to why the media run a story on this alleged leak but avoid publishing the e-mail, and as to why the likes of ToffeeWeb have removed it having once published.

So for the time being at least (until I get home from work to evaluate), it would be appreciated if you all please do us a favour and not publish any private e-mails on here.

I'm not a lawyer, but my job is closely related to information security and risk. By definition, the Internet is open, and public domain; ergo, unless an individual takes specific measures to protect their communication (i.e. encryption), they can have no expectation of privacy, if they choose to send an email over the Internet. Not only is the information sent in the clear, any given piece of infrastructure which the email passes through on it's route will also be capable of retaining a copy of it.


It sounds unlikely that the emails which are being talked about at Everton would probably have been sent via the Internet (but we don't know that for certain) - however, generically speaking, emails are not private by default.

Sensible move to ask people not to post them, regardless.

Though that implies the e-mail was actually sent - I suppose an argument could be made that it's libellous fiction?

I have absolutely no idea on the implications of libel - even if you're just repeating something that someone has already posted and not altering it in any way, you could still end up in hot water.

I will correct myself above though, I'm currently reading the emails, published elsewhere, it appears Mr. Ross uses an AOL address, so in theory, unless using a specific protection method, he can have no expectation of privacy.

You're right - it could all be fictional and this is nothing. If that was the case I'm sure EFC would have told us that by now :)
 

if it's fiction then the facebook page and all his linked friends (most of whom appear int he email chain) are all fiction too. Extremely elaborate fiction! or just a case of editing the email address...

They will argue the cause of 'damaging the clubs image', or by way of defamation.

I manage the security of a large legal firm,i expect you're pre-empting a legal call from Everton FC asking for them to be taken down, they ( the emails ) are publicly available by way of a simple google search.

Furthermore, the problem of them ' legally ', implicating your or the site is something no court in the land would entertain this.

There is no legal regulation, compliance or investigative handling procedure for this.

The responsibility from the club ( or employees ) to maintain a secure method of communication should be just that, their responsibility, i won't argue it's perhaps in bad taste ( so, my fault ).

There is a de facto standard set out for 'best practises' these are laid in ISO/IEC 27002, which covers a lot of your concerns.

Historically, it's more likely to be the actual ' leaker ', rather than someome publishing the information to feel the wrath of any ( at all ) court, or legal order which considers information unlawfully procured in any sense.

In short, as none of 'us' here have directly intercepted these alleged emails, there is very little to stop anyone from publishing them.

Although i agree in the sentiment of it being in poor taste.

Listen I know you had an inkling but just to confirm that we've got to the bottom of this sniderman thing and it's been Muggins and Mutzo Nutzo using a duplicate account. We're taking action but obviously need to keep it down as Muggins is a moderator so this can't get out and lose us face.

I get so confused - voices ....always voices. I dont know who I am anymore - I did that google imager thing and typed in Mutzo Nutzo - and this came up!!!!!
