one question would be, are they in the last 6 months of their contract (or year if it's over a certain length) if so yes. You don't need permission from their Club to talk to them.

Only if they are away playing for England in a tournament and they get their other players to tap them up throughout it so that they never play for us again and demand a transfer on the last day of the window.
