Reminds me of that woman who successfully sued McDonald's for getting burned by hot coffee, which she'd bought herself. That's why coffee cups say "CAUTION STUPID PERSON, THE CONTENTS OF THIS IS HOT!" on them.
Quite a bit more to that story. It was actually a very messed up situation. We were taught this case in law school to show how misinformed most people are about lawsuits in the news.
The coffee you typically buy is served at 135 degrees fahrenheit (57 celsius). The coffee served to her was served at 190 degrees fahrenheit (87 celsius). It was so hot the cup failed and she suffered THIRD degree burns to 6% of her body, specifically her external and internal genitals.
All of this because McDonalds knowingly served coffee at 190 degrees fahrenheit despite industry standards of 135-140 degrees and despite over 700 claims against McDonalds from people burned by the coffee over the previous 10 years. Internal memos show McDonalds was aware of the issue and specifically ignored it.
The woman underwent surgeries and after insurance owed in excess of $20,000 to repair the damage and only asked for McDonalds to pay her medical bills. It was only after they refused her that she sued for punitive damages.
She was ultimately awarded $160,000 in compensatory damages for the medical bills and $480,000 for punitive damages because McDonalds recklessly disregarded the fact that 190 degree coffee could cause THIRD degree burns if spilled. Claims that she won millions are false. In fact, McDonalds makes about $1.35 million per day in coffee sales, and so a punitive award of $480,000 was about 8 hours worth of profit for McDonalds for coffee sales. Hardly absurd.
