6 + 2 Point Deductions

We agreed to the rule changes and signed up to them.

We quite clearly broke the rules. You can deny it but they tried there best to help us out by signing off 220 million worth of losses to Covid.

Other than PSG we had the highest turnover to wages ratio in Europe. It was at 98 and 97% for two seasons straight. We lived beyond our means and gambled about getting into Europe. It failed.

Simple question, did we break the rules?


The rules that were changed in August of that year. We were charged with the breach in March and then these new rules were implemented in August before the " independent panel " made their truly impartial verdict in November.

So the rules were changed after the initial charge, it's like being caught speeding and then being told a week before the trial that instead of points on your licence it's actually now the death penalty if you are found guilty.
 

I think there is 0% chance of this being dismissed / thrown out.

A settlement would seem to be the most likely outcome. Burley get something and avoid a protracted and delayed outcome, and we limit the damage.
 
That’s a good explanation. It’s hard to quantify what Burnley’s table position would have been “but for” Everton’s overspend.

Also, to be pedantic for a second, the legal standard for civil cases is typically “more likely than not” which is sort of like “we’re 51% certain” whereas “beyond a reasonable doubt” is 100% certain.

It’s way easier to prove the first. The latter is the standard for criminal charges.

Got you, I thought balance of probabilities, but I suppose the ones is still on them to prove a more likely than not.

I'm sure there's an argument to also state Everton were spending on wages below the mean of the league, and on transfers in the bottom half of the league on a net basis. If we were to analyse the spend, it would show a below average spend. I would suggest that stating an org that spends below average, is the cause of your failure isn't the most compelling argument.

But yes, the main point is really that it is "unquantifiable" which has already been acknowledged by a quasi legal org of alleged legal experts. Burnley need to prove it is both quantifiable, and quantifiable to the degree that it negatively impacted them.

What new rules got implemented in that August?

You saying also these rule changes got charged retrospectively back onto us? I don't think any of that happened at all.

We also never got found guilty, we admitted guilt at the pre-trial.
 

Let’s not forget that Burnley sacked Dyche after losing 5 of his last 6 games in charge and appointed an interim manager for the remaining 8 games.

They knew they were in danger of being relegated regardless of Everton’s PSR breach after the season ended.

If they had stuck with Dyche they would have been miles away from us at the end of the season.

The PL hadn't got it's act together to punish us within the same season, not our fault. You can't say we would have definitely been down had we got a deduction, as we would approach games differently knowing what was required.

Good point Leeds will have their begging bowl followed by, wait for it Leicester, those deduction dodgers.. We've been punished twice already, two separate points deductions, enough is enough don't give up without a fight and if we lose keep on appealing to the end of Eternity. :)
 
The independent commission didn't say this. They said there was no "quantifiable" advantage. They need to be able to quantify the advantage to being greater than the points difference to be relegated. Given it's been deemed as unquantifiable (either too small to merit a value, or impossible to state) I can't see how that can be done.

If I was a judge, my follow up question to them pointing it out would be- "would you be able to quantify the value of the advantage they gained".
The commission said there was a sporting advantage - that is a cast iron fact.

I think Angus Kinnear needs to be fighting this aggressively because of his shenanigans when he was Leeds CEO.

A motivational chat from the Friedkins is needed to put him firmly on notice if this goes awry…you reap what you sow comes to mind.
 
The initial ten points deduction imposed was the highest in the history of the Premier League, even more than clubs who went into administration.

Nobody was even thinking about a single point being deducted at all let alone ten which sent shockwaves through the game not just in this country

If you can't see that as being shafted then god help your eyesight.

Spurs had a deduction of 12 imposed by the FA, interestingly for a case very, very similar to any of Chelseas 74, but somehow Alan Sugar managed to get them all returned to them, by way of a loophole that is now closed off.
