6 + 2 Point Deductions

One hundred percent agree, we handled our case badly.

It becomes all too subjective, different panels, different ideas.

Example - our benchmark was higher than Forest and you only get one appeal. Forest went in, bigger more arrogance breach, at a lower level from the off.

We also were thankful and apologetic, we actually thanked the league for the deduction - other clubs had the front to argue the toss which helped them.
 

For me, there are two possible arguments Burnley could have:

1. If the points had been deducted the season they went down, we would've been relegated instead.

2. Breaking the rules gave us a sporting advantage that resulted in us finishing above them.

I think argument 1 is out instantly - we didn't choose the dates of our punishment.

Argument 2 requires them to prove we gained a sporting advantage. The independent commission themselves said we did not break the rules in order to gain a sporting advantage, and we'd spent peanuts in the years leading up to the sanction.

I just don't see how they win this. I also think any judge would be reluctant to set a precedent like this.

Yes, and we got the sanctions as per the rules. The rules don't then go onto say and all clubs who may possibly have been affected can sue you. Anyone can see the situation is ridiculous and should be thrown out of any non kangaroo courts. It's like the whole butterfly effect, absolute nonsense the whole thing!!

Perhaps we could go back and sue the RS for getting us banned from Europe, or lets now try and sue Moshiri for breaking the rules, counter sue Burnlye for sacking Sean Dyche and making him.available to manage us...open up multiple hypothetical cans of worms.

They have to prove in that season the advantage was 5 points.. We got docked 8 points for 3 years of "rule breaking" the punishment infers a yearly advantage of 2.6 points.

Also Chelsea beat us in the 2009 fa cup final, we could have a go at them as their 74 breaches reach back to 2009.

Absolutely, and I can't see any way that they'll be able to do that. Even with this business about chance, I am 100% sure that Burnley don't deserve anything.

I replied to the above because I won't ever see anyone say the commission said Everton didn't get a sporting advantage and not respond to it. It's just misinformation.

You can't possibly say that Everton gained 4 or more points more in 2023/24 because of it - which is the precise threshold Burnley need to prove exists.
 

Exactly! Burnley are just a bitter championship level club who can't take ownership of their own inadequacies. I hope this whole thing gets thrown out and it costs them a small fortune in legal fees.
Burnley were in pole position to stay up after beating us in April 22 and were 2 points ahead having played 1 game more.

They got 4 points in their last 5 games and we got 10 from our last 6…they blew their chance whilst Evertonians pulled a desperately poor team over the line.

I think Chas and Dave would be singing “Gertcha” at Burnley…

The only way the advantage can be inferred is by taking the total punishment and divide it by 3 to get the inferred advantage per season.

They probably don't need to 'prove' it exists (i'm not a lawyer, i'm just applying logic not knowledge). Their claim is effectively that we cheated and they didn't and so they were deprived of a fair chance to stay up. As I said earlier, it seems strange to me that this is happening and it could potentially open a massive can of worms, but the indications are that there is a case there so we can all sit here and say what they need to do and how it won't stand up but it appears that it isn't quite that clear cut.
