6 + 2 Point Deductions

We finished 4 points and two places ahead of them, if this is the season they are moaning about. So many ifs, buts and maybes in football. How can they say that we would have 100% finished below them if we had been deducted points? It may have galvanised us and we may have finished further ahead. How does this not get laughed out of court?

Didn't we get two public apologies for incorrect VAR calls that season?

Perhaps we could sue the PGMOL in this case as without such decisions we may have stayed up with six points deduction being retrospectively applied.

Not sure how you can have a retrospective 2nd punishment. You either apply punishment after a breach (the points deductions) or apply it to before/during but to do both is double counting.

In the 2021-2022 season, there was no actual breach yet. At that time, Everton were still in the process of working towards compliance. Therefore, they could not have been gaining a "sporting advantage" from a breach that had not yet occurred until the 3 years in question were complete.

And had the points been deducted during the 2021/22 season Everton would have known what points they needed to stay up (as in 2023/24) an opportunity that was denied them by the PL's own process.
 

The case that the punishment the PL imposed on Everton didn't reflect the season that PSR was breached and therefore contributed to them getting relegated?
I've no idea what case they could take against Everton. And if there is one, can forest be sued. Can Chelsea and City?
Can one club sue another for a poor VAR decission that costs PL places and the millions that come with it.
These clubs are all memebers of a league, a league that specifically broke away from the football league for more self determination.
They all signed up to the rules. You get your chance to argue your corner against the league. Everton did that poorly and lost.
Arguing that case against other clubs who dont control any punishment is mad.
I think you are agreeing with the point I was making, it’s the PL to blame not the clubs for this mess. But as I understood it at the time there was nothing in the PL rules about how long a PSR case would take to be resolved, therefore knowing this I’m not sure Burnley could bring a case against the PL on the fact it rolled over seasons.

Makes it sound like trying to end a war, not a spurious complaint from Burnley ffs.

My concern is that this is going to automatically result in some agreed settlement - not too much for us, but not too little for them.

The problem from the offset was the Chair of the "Independent" points deduction commission concluding that clubs had a valid claim against us.
