The high boot occurred before the handball. Jagielka is protecting himself, so he gives the free-kick for the first foul. It's not difficult. Otherwise Oviedo wins a penalty.

Yeah I'm the first to call a cheat but Jags had his head down and hands up, part of me thinks he hoping to get fouled, not punch the ball!
