Burnley need a 13 point deduction before it sways in their favour of reaching the more than 4 points they need per season.. It's not possible to prove what they are calming, I don't expect we'll ever hear the outcome but I hope we fight this and don't give them anything.
 

They probably don't need to 'prove' it exists (i'm not a lawyer, i'm just applying logic not knowledge). Their claim is effectively that we cheated and they didn't and so they were deprived of a fair chance to stay up. As I said earlier, it seems strange to me that this is happening and it could potentially open a massive can of worms, but the indications are that there is a case there so we can all sit here and say what they need to do and how it won't stand up but it appears that it isn't quite that clear cut.
If Burnley win this I can see all pending cases from the PL being dropped mainly City and Chelsea... Pl will claim that this sort of thing cant be allowed to happen again so on a technicality withdraw action.

The Premier League tried there best to get us off when they wiped off a few hundred million losses to covid.

For years we had the highest wages to turnover ratio in the Premier League. Moshiri took a gamble and hoped we could get into Europe to grow the revenue. The gamble failed and then Russia invaded Ukraine.

I think in principle there's no place for club-on-club lawsuits like this.

It was a breach of league rules, ruled on in the manner and timeframe decided by the league - and punished inline with those same rules.

If those rules and their associated punishments are disadvantaging other teams, that's on the league and not the clubs.

Burnley were in pole position to stay up after beating us in April 22 and were 2 points ahead having played 1 game more.

They got 4 points in their last 5 games and we got 10 from our last 6…they blew their chance whilst Evertonians pulled a desperately poor team over the line.

I think Chas and Dave would be singing “Gertcha” at Burnley…
Feels slightly disingenuous.

Three days later, we beat Man Utd. When we had played the same amount of games, they were still 1 point behind. They were hardly in pole position.
I accept that we weren't favourites to beat Man Utd, and it's definitely true that our end-of-season form was much better than theirs, but you are being very selective with what date you are choosing to put them as favourites to stay up.

In all seriousness it is genuinely quite disappointing that a lot of our fans seem to take the line that we didn't do anything wrong. I think the original punishment was way too harsh and the lack of consistency was a joke, but we shouldn't lose sight of the fact that we did break the rules and if another team had done that and benefited from it at our expense we'd be furious about it.

Well Forest got half the points deduction than us with seemingly double the breach, fans look for consistency and see the likes Man City, Chelsea spending absolute fortunes, what 10 years ago was it and still waiting for judgement. Yes we weren't perfect, but being told we should have foreseen the Russian invasion of Ukraine and losing our main sponsor through it was I thought a mite unfair.

According to claims first reported by the Times, Leeds and Burnley have asked for clarity over whether Everton’s losses of £371.8m over the past three years break financial fair play rules. The rules allow for maximum losses of £105m over a three-year period and, although they were adjusted to allow clubs to write off losses incurred because of the pandemic, the complainants argue that Everton’s apparent Covid losses are far larger than other clubs’.

In their last accounts, Everton said £170m of their losses had been related to the pandemic. Aston Villa put their figure at £56m and Arsenal said £86m had been lost because of Covid.

In March Everton’s CEO, Denise Barrett-Baxendale, wrote in the club’s annual accounts: “Losses of at least £170m are attributed to the impact on the club of the Covid-19 pandemic, with £103m of that figure coming in the 2020-21 financial year.

I covered that in my post? The punishment was too harsh and the fact it wasn't applied consistently was ridiculous, but it doesn't change the fact that we did actually break the rules, that's all i'm saying.

We didnt bend the rules, we broke them, we then admitted we broke them.
